Sweepstakes Rules

These Sweepstake Rules ("Rules") apply to the 25th Anniversary Skistakes promotion ("Sweepstakes") conducted for The Homestead, a destination resort located in Glen Arbor, MI 49636 ("Resort") by its owner, The Bayberry Group, Inc., a Michigan corporation ("Sponsor"). By entering this Sweepstakes, you agree to these Rules, acknowledge that the Sweepstakes are subject to all applicable federal, state and local laws and regulations and understand that they are void if prohibited by law.

1. Start and End Dates. The Sweepstakes will start at 12:01 am on Saturday, December 20, 2008 and will end at midnight on Sunday, March 29, 2009.

2. Eligibility. Sweepstakes entrants and prize recipients must be citizens of the United States who are 18 years of age or more at the time of entry to be eligible. Employees of the Sponsor, its affiliated companies and other entities working on the Sweepstakes for the Sponsor are not eligible.

3. To Enter: You may enter the Sweepstakes by completing an entry form located at the front desk and any points of sales throughout The Homestead. Your entry will be valid if it provides your complete name, home address, daytime or evening phone number, e-mail address and date of birth. You may enter as many times as you like. Your entry constitutes your consent to participate in the Sweepstakes and your permission, if you are a winner, to the use of your name, picture and/or likenesses with the name of your home town for purposes of advertising and promotion without further compensation and for other uses unless prohibited by law. Your entry does not constitute your consent to your name and contact information being given to any other person or entity for any other purpose and it will not be. The Sponsor is not responsible for an entry which is lost or damaged or destroyed or received too late to be eligible to participate.

4. Prizes. The prizes in this Sweepstakes and their approximate retail value are as shown on the table below.

Odds of winning any prize in this Sweepstakes depend on the number of eligible entries received. Only one weekly prize will be awarded to any one entrant. Winning one of the weekly prizes does not disqualify that winner from the chance to win the Grand Prize. Prize winners will be responsible for all costs associated with the acceptance and use of a prize and for any federal, state and local taxes on prizes. Any difference between stated approximate retail value and actual value of prize will not be awarded. All prizes are valid for a one-time use, are non-transferable and must be redeemed within six months of the date awarded. No cash refund of all or any part of the retail value of a gift certificate will be given. If a prize winner notification is undeliverable, a prize winner is ineligible or a prize winner declines a prize, an alternate winner will be awarded the prize.

5. Selecting Winners.Prize winners and alternate prize winners will be selected by an electronic drawing conducted by an independent consultant on each Sunday during the 25th Anniversary Skistakes beginning on Sunday, December 28, 2008 and ending on Sunday, March 29, 2009. Winners will be notified via a previously provided email address.

6. Claiming Prizes. Prize winners will be notified via e-mail of their prize. Winners must respond to claim their prize within 10 days of being notified. Winners may pick up their prizes at the Resort's Reception Center. To do so, prize winners must present proof of identity and may be asked to give the Sponsor an affidavit of eligibility and a liability and publicity release. If the approximate retail value of the prize winner's prize is greater than $100, the prize winner will be asked to supply the Sponsor with their social security number for tax purposes. If a prize winner is chosen but fails to comply with these rules, the winner will be disqualified and the winner's prize will be awarded to an alternate prize winner.

7. Obtaining a List of Winners. To obtain a list of winners, please send a self-addressed, stamped, Number 10 envelope no later than, March 29, 2009 to the address shown in Paragraph 2 above.

8. Internet. If this Sweepstakes cannot be run as planned due to a malfunction of the computer systems used by the Sponsor or consultant which is caused by any form of unauthorized intervention by any individual or individuals or otherwise beyond the control of the Sponsor or consultant, the Sponsor, in its sole discretion, may disqualify any individual or individuals who the Sponsor, in its sole discretion, believes to have caused the problem. Further, the Sponsor may modify the Sweepstakes and, if necessary, conduct a different type of drawing to determine winners. The Sponsor assumes no responsibility for any error or change or damage caused by unauthorized intervention or any form of technical malfunction or any human error. The Sponsor is not responsible for incompatibility of a prospective entrant's or an entrant's computer hardware or software or other technology with the hardware, software and other technology used by the Sponsor or consultant.

9. Disputed Address. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be the natural person who was the authorized account holder of that address at the time the entry from that address was submitted as determined by the access provider, on-line service provider or other provider.

10. General. By entering this Sweepstakes, each entrant and prize winner: (a) releases Resort and Sponsor and their directors, officers, employees shareholders, affiliates and consultants from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Sweepstakes, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery; (b) consents to the use of their name, voice and picture or likeness for advertising and promotional purposes in any medium in any location in perpetuity without additional compensation unless prohibited by law; and, (c) acknowledges that no one has made or is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, condition, or fitness for a particular purpose. Sponsor may terminate or modify the Sweepstakes if it becomes aware of any occurrence that would materially affect security and fairness. Sponsor may prohibit individuals from participating and/or disqualify entries if an individual attempts to improperly enter or disrupt the Sweepstakes or to circumvent these Rules in any way or act in an unsportsmanlike manner or with an intent to annoy, abuse, threaten or harass anyone involved in the Sweepstakes. Decisions on all matters related this Sweepstakes, whether made by Sponsor or its consultant, are final and binding in all respects.

11. Use of Information. The information on your entry form may be used by the Sponsor to send you printed, recorded or electronic materials relating to the Resort's facilities, packages and special promotions. The information on your entry form will not be provided to third parties except as needed for administration of the Sweepstakes or as required by law or legal process. If you do not wish to receive materials from the Sponsor, please make sure to uncheck the appropriate box or boxes on your entry form.
